A few important details.

We will always do our best, but sometimes it’s best to have a few things written down so that we both know what’s what, who should do what and what happens if stuff goes wrong. We do want what’s best for the safety of both parties, now and in the future.

Some definitions
“Claim” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising including but not limited to negligence. “SWC” means C & C O’Beirne TAS Swimming Women.
“SWC Activities” means performing or participating in any capacity in any activity organised by SWC. “SWM” means the Swimming Mermaids Inc., and association incorporated under Western Australian law.

Membership of the Swimming Mermaids Inc.

As part of the terms and conditions herein, I hereby apply to membership of the Swimming Mermaids Inc, an association with the aim of promoting the sport of swimming, swim coaching and social aspects related to swimming.  I acknowledge my application to join Swimming Mermaids will be deemed to be accepted upon my participation in Swimming Women Activities as outlined in the Memorandum of Understanding between Swimming Mermaids and Swimming Women. I acknowledge that I will be bound by and agree to comply with the constitutions, regulations and policies of the Swimmimg Mermaids Inc. These rules are necessary and reasonable for promoting Swimmimg Mermaids as an association.

Memorandum of Understanding

A Memorandum of Understanding exists between Swimming Mermaids Inc and Swimming Women to deliver coaching services related to swimming to further the aims of the Swimming Mermaids Inc.

Release and Indemnity

I agree to (a) release SWC and SWM from all Claims that I may have or may have had for this release arising from or in connection with my membership and/or participation in any SWC and SWM Activities; and (b) indemnify and will keep indemnified SWC and SWM to the extent permitted by law in respect of any Claim by any person arising as a result of or in connection with my membership and/or participation in any SWC  and SWM Activities. I understand that SWC and SWM will take no responsibility for accident, loss or injury suffered by myself during the course of the activity. I declare that I will follow the rules of use as set out by the Margaret River Recreation Centre (MRRC).

Fitness to Participate

I declare that I am medically and physically fit and able to participate in any SWC and SWM Activities. I am not and must not be a danger to myself or to the health and safety of others. I will immediately notify SWC in writing of any change to my medical condition, fitness and ability to participate.

Privacy
We love to talk about swimming and what we have learned with other people, so we reserve the right to share information about sessions you have been involved in on digital media and traditional media platforms. All information collected  about you is solely for the purpose of providing better and more efficient services and to keep you informed of swimming activities. In obtaining your information, we do so in strict accordance with the Privacy Act.

This contract is a legal document under exclusive jurisdiction of the State of Western Australia. I have provided the information required online on the enrolment form and completed this form. I warrant that all information provided is true and correct. I acknowledge that this declaration cannot be amended. If I do amend it my application will be null and void and cannot be accepted by SWC and SWM.
