A few important details.
Sometimes it’s best to have a few things written down so that we both know what’s what, who should do what and what happens if stuff goes wrong. We do want what’s best for the safety of both parties, now and in the future.

There are numerous obvious risks to participating in ocean swimming.Obvious risks include and are not limited to the following: injury and/or drowning, due to being hit by other persons, objects or boats. Other obvious risks include, cold weather and water, entry and exit injuries, stings, sandbars, medical conditions and marine animal interactions.
Some definitions
“Claim” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising including but not limited to negligence. “SWC” means C & C O’Beirne TAS Capes to Coast.
“SWC Activities” means performing or participating in any capacity in any swimming activity or swimming tour organised by SWC.
Release and Indemnity
I agree to (a) release SWC from all Claims that I may have or may have had for this release arising from or in connection with my membership and/or participation in any SWC Activities; and (b) indemnify and will keep indemnified SWC to the extent permitted by law in respect of any Claim by any person arising as a result of or in connection with my membership and/or participation in any SWC Activities. I understand that SWC will take no responsibility for accident, loss or injury suffered by myself during the course of the activity.
Fitness to Participate
I declare that I am medically and physically fit and able to participate in any SWC Activities. I am not and must not be a danger to myself or to the health and safety of others. I will immediately notify SWC in writing of any change to my medical condition, fitness and ability to participate.
Cancellations
Along the way we aim to be at every session but occasionally things go wrong that you can’t control and we will endeavour to provide another teacher for your session, or arrange a make up session if the problem is caused by SWC. Due to the short nature of the 8 week program, make up lessons will not be offered if you miss one for whatever reason or a problem arises due to third party outages.
Privacy
We love to talk about swimming and what we have learned with other people, so we reserve the right to share information about sessions you have been involved in on digital media and traditional media platforms. All information collected by SWC about you is solely for the purpose of providing better and more efficient services and to keep you informed of SWC activities. In obtaining your information, we do so in strict accordance with the Privacy Act.
Payments
We are sure you understand how important it is as a small business that you pay for the program promptly. You agree to stick tight to the payment terms whereby all money is to be paid in advance. Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction of the State of Western Australia.
I have provided the information required online on the enrolment form and signed this form. I warrant that all information provided is true and correct. I acknowledge that this declaration cannot be amended. If I do amend it my application will be null and void and cannot be accepted by SWC.
